How Fast Can You Obtain a Massachusetts Divorce?
The speed in which you can get divorce depends on 2 things: you and the court system.
You, Who Are Divorcing Each Other
Let’s focus first on you. When I say you, I mean both of you who are divorcing each other. If you’ve got all your ducks in a row and everything has been negotiated and there is nothing to argue about, then your divorce will be quick and smooth (subject to the court system). If however, you don’t agree to the divorce or you don’t agree to any of the terms of the divorce then the case is contested and it will be a long and tough journey (also subject to the court system).
The Court System in Massachusetts
The Probate and Family Court system varies depending on which county you’re filing your divorce. Some counties are faster than others. Some counties allow same-day walk-ins and others do not. Generally, an uncontested divorce can be finalized in about 4-5 months. A contested divorce cannot be final before at least 9 months is up.
The above is rough guidelines and each court is different. However, what you should be able to see is that the Massachusetts court system is entirely out of your control. The only thing you have control over is the part between you and your spouse. If you want the divorce to be over quickly and smoothly, then it is best to cooperate with each other, listen to each other, and be open to each other’s position and negotiate.
